This policy applies to information we collect through the Site and in the course of responding to inquiries and providing our services. It does not apply to third-party websites or services we link to, which have their own privacy policies. If you are a client, additional data terms may be set out in your Engagement Agreement.
When you submit a contact, consultation, audit, or press form — or otherwise communicate with us — we collect the information you choose to provide. Depending on the form, this may include: your name; email address; phone number; company or business name; website URL; whether you currently have a website; the services you are interested in; your estimated monthly budget; and any message or details you include. For press inquiries, we may also collect your outlet, role, topics, and deadline. We also collect the content of your communications with us.
When you use the Site, we and our analytics providers automatically collect certain technical and usage information, such as your IP address (from which approximate location may be derived), device and browser type, operating system, referring URLs, the pages and content you view, links you click, and dates and times of access. We collect this information using cookies and similar technologies, including Google Tag Manager and Google Analytics.
We use cookies and similar technologies to operate the Site, remember preferences, and understand how the Site is used. These include essential cookies needed for the Site to function and analytics cookies set through Google Tag Manager and Google Analytics that help us measure traffic and improve the Site.
You can control cookies through your browser settings and can opt out of Google Analytics using Google’s opt-out browser add-on at https://tools.google.com/dlpage/gaoptout. Blocking some cookies may affect how the Site functions.
We use the information we collect to: respond to your inquiries and provide the information, proposals, or services you request; set up and manage client relationships and records in our customer relationship management (CRM) system; deliver, maintain, and improve the Site and our services; send you administrative and, where permitted, marketing communications about our services; analyze usage and measure the effectiveness of our content and campaigns; protect the security and integrity of the Site; and comply with legal obligations.
We do not sell your personal information. We share information only as needed and with:
• Service providers and processors who perform functions on our behalf — for example, Google (Google Tag Manager and Google Analytics) for website analytics; Zoho (Zoho CRM) to store and manage inquiries and leads; our email delivery provider to send and receive messages; our website hosting and content-management providers (including our Sanity CMS); and similar vendors, each of which is permitted to use the information only to provide services to us.
• Legal and safety recipients, when we believe disclosure is required by law or legal process, or necessary to protect rights, safety, or property.
• A successor entity, in connection with a merger, acquisition, financing, or sale of assets, subject to this policy.
We use artificial intelligence and automated tools to help create and optimize content on the Site and in our services. These tools operate under our direction and review. We do not use the personal information you submit through the Site to train third-party generative-AI models except as needed to provide the services you request or with your consent. Automated content is reviewed by our team, but may contain errors and is not a substitute for professional advice.
We retain personal information for as long as needed to fulfill the purposes described in this policy — including to respond to your inquiry, maintain our client and business records, and comply with legal, tax, and accounting obligations — after which we delete or de-identify it. Retention periods vary based on the type of information and the reason we hold it.
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
Depending on where you live, you may have the right to access the personal information we hold about you, to correct or delete it, to opt out of marketing, and to opt out of certain uses of your information. To exercise any of these rights, contact us at [email protected]. We will respond as required by applicable law and will not discriminate against you for exercising your rights.
If you are a California resident, the California Consumer Privacy Act (as amended by the CPRA) gives you the right to know the categories and specific pieces of personal information we collect, to request deletion or correction, to opt out of the "sale" or "sharing" of personal information, and to limit the use of sensitive personal information. In the past 12 months we have collected the categories of information described in Sections 2 and 3 above (identifiers, commercial information, internet/network activity, and inferences). We do not sell your personal information and do not knowingly share it for cross-context behavioral advertising. To exercise your California rights, contact us at [email protected].
If you are in the European Economic Area or United Kingdom, we process your personal data on the legal bases of your consent (for example, non-essential cookies and marketing), our legitimate interests (for example, operating and improving the Site and responding to inquiries), performance of a contract, and compliance with legal obligations. You have the right to access, correct, delete, restrict, or object to processing, to data portability, and to withdraw consent, and you may lodge a complaint with your local supervisory authority. To exercise these rights, contact us at [email protected].
If we send you marketing emails, you can opt out at any time by using the unsubscribe link in the email or by contacting us at [email protected]. We may still send you non-promotional messages about active engagements or your requests.
The Site and our services are intended for businesses and adults. We do not knowingly collect personal information from children under 16. If you believe a child has provided us personal information, contact us and we will delete it.
We are based in the United States, and the information we collect is processed in the United States and may be processed by our service providers in other countries. Where required, we use appropriate safeguards for cross-border transfers. By using the Site from outside the United States, you understand your information will be processed in the United States.
The Site may link to third-party websites and services. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies.
We may update this Privacy Policy from time to time. The "Last updated" date above reflects the most recent version, and changes are effective when posted to the Site. If we make material changes, we will take reasonable steps to notify you where required.
If you have questions about this Privacy Policy or how we handle your information, or to exercise your privacy rights, contact Swarm Digital Marketing, LLC at [email protected] or (855) 244-4407, or by mail at our Tampa, FL or New York, NY offices.
